Asbestos Management Plan
Under the Health and Safety at Work (Asbestos) Regulations 2016, all businesses that occupy premises that may contain “Asbestos-containing materials” (ACM’s) must, by law have a relevant Asbestos Management Plan in place.
What is an asbestos management plan?
The Asbestos Management Plan is a legal document that holds key site-specific information around any ACM’s identified or presumed within it, it should include any inspections or surveys undertaken along with the material and priority risks, key people responsible for its upkeep, action plans, decisions on actions and reasons for actions in each case as well as emergency plans and contact information.
The management plan is yes a 5-year review the main factors being the change of building use, different activity etc, additional personnel, and heightened maintenance visits, all which could impact the asbestos-containing materials.
Who is the plan for?
The asbestos management plan must be made available by the PCBU to workers and their representatives as well as other relevant PCBU’s. a copy of the asbestos management plan must remain in the workplace.
When does the plan need to be updated?
The asbestos management plan must be updated every five years or when:
- asbestos controls are reviewed
- asbestos is removed, disturbed, sealed, or enclosed
- the plan is no longer adequate for managing the asbestos risks. For example, if new asbestos is identified, or if a previously inaccessible area is now accessible.
As well as this if a representative for the workers in any specific workplace can request a review of the asbestos management plan if:
- any of the situations noted above affects, or may affect, the health and safety of a member of the workgroup being represented, and
- the workplace PCBU has not adequately reviewed the asbestos management plan in relation to the situation.
Is a surveyor required to produce the plan?
Not necessarily – a competent PCBU can in fact prepare their own asbestos management plan, however, it is essential that the plan is correct and that the decisions regarding the management of the ACM’s are made in-line with the Management and Removal of asbestos ACOP, found here.
